La <em>Ley de Bases<\/em> est volumineuse et couvre de nombreux pans de l\u2019\u00e9conomie, mais aujourd\u2019hui nous nous concentrerons sur la r\u00e9forme du droit du travail (la \u00ab\u00a0R\u00e9forme du Droit du Travail\u00a0\u00bb) [1].[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbEmploi Non D\u00e9clar\u00e9 : Plan d&rsquo;Amnistie et de R\u00e9gularisation Volontaire\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]La R\u00e9forme du Droit du Travail appelle \u00e0 une r\u00e9gularisation\u00a0volontaire par les employeurs de tous les emplois non d\u00e9clar\u00e9s et sous-d\u00e9clar\u00e9s. Dans un march\u00e9 qui impose des co\u00fbts de main-d&rsquo;\u0153uvre et des indemnit\u00e9s de licenciement significatifs, les employeurs ont traditionnellement \u00e9t\u00e9 tent\u00e9s de ne pas d\u00e9clarer les emplois ou de sous-d\u00e9clarer les salaires. Les r\u00e8gles doivent encore \u00eatre \u00e9tablies, mais les employeurs adh\u00e9rant au Plan devraient b\u00e9n\u00e9ficier des avantages suivants :<\/p>\n<p>&#8211; Annulation d\u2019au moins 70 % de toutes les cotisations de s\u00e9curit\u00e9 sociale impay\u00e9es et associ\u00e9es aux manquements pass\u00e9s.<\/p>\n<p>&#8211; B\u00e9n\u00e9fice d\u2019un plan de paiement pour le restant des cotisations de s\u00e9curit\u00e9 sociale impay\u00e9es.<\/p>\n<p>&#8211; Expurgation des violations suite \u00e0 la r\u00e9gularisation des manquements pass\u00e9s (ce qui emp\u00eacherait autrement l&#8217;employeur de se qualifier pour des contrats publics).<\/p>\n<p>&#8211; Rejet de toutes les proc\u00e9dures p\u00e9nales en cours pour \u00e9vasion.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bb\u00c9limination des P\u00e9nalit\u00e9s dans la R\u00e9forme du Droit du Travail\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]La R\u00e9forme du Droit du Travail \u00e9limine les p\u00e9nalit\u00e9s applicables \u00e0 un employeur pour non-respect de la l\u00e9gislation concern\u00e9e. Cette mesure aura probablement un grand impact sur le march\u00e9 du travail, car ces p\u00e9nalit\u00e9s multipliaient souvent par deux les indemnit\u00e9s de licenciement et imposaient un suppl\u00e9ment de 25 % de toutes les r\u00e9mun\u00e9rations non d\u00e9clar\u00e9es pour l\u2019employeur. De plus, les p\u00e9nalit\u00e9s \u00e9taient payables aux employ\u00e9s plaignants, et non aux pouvoirs publics, ce qui en faisait un moteur cl\u00e9 des litiges sociaux. L&rsquo;\u00e9limination de ces p\u00e9nalit\u00e9s, potentiellement \u00e9crasantes pour l&#8217;employeur, signifie un soulagement important pour l direction.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbProlongation de la P\u00e9riode d&rsquo;Essai\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]La R\u00e9forme du Droit du Travail prolonge la \u00ab\u00a0p\u00e9riode d\u2019essai\u00a0\u00bb de trois \u00e0 six mois. Cela peut ne pas sembler beaucoup, mais la p\u00e9riode d\u2019essai signifie qu\u2019un employeur peut mettre fin \u00e0 un contrat durant ce d\u00e9lai sans payer d\u2019indemnit\u00e9 l\u00e9gale. Dans un march\u00e9 qui accumule rapidement des droits de licenciement importants, permettre \u00e0 l&#8217;employeur de disposer de plus de temps pour \u00e9valuer un employ\u00e9 sans co\u00fbt suppl\u00e9mentaire est significatif.<\/p>\n<p>Pour les employ\u00e9s b\u00e9n\u00e9ficiant d\u2019une convention collective, la R\u00e9forme du Droit du Travail permet aux conventions collectives d\u2019\u00e9tendre la p\u00e9riode d\u2019essai jusqu\u2019\u00e0 huit mois (pour les employeurs ayant de six \u00e0 cent employ\u00e9s) ou jusqu\u2019\u00e0 un an (pour les employeurs ayant moins de six employ\u00e9s).[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbCong\u00e9s Maternit\u00e9 : Flexibilit\u00e9 Accrue\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]Le droit du travail argentin pr\u00e9voit trois mois de cong\u00e9s maternit\u00e9 pay\u00e9s, dont au moins un mois doit \u00eatre pris avant la naissance. Les employ\u00e9es enceintes peuvent d\u00e9sormais r\u00e9duire le cong\u00e9 pr\u00e9natal \u00e0 seulement 10 jours et ajouter le solde au cong\u00e9 postnatal.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbFonds de Licenciement \u00c9tabli dans la R\u00e9forme du Droit du Travail\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]La R\u00e9forme du Droit du Travail introduit une alternative au versement traditionnel des indemnit\u00e9s de licenciement. Pour les employ\u00e9s soumis \u00e0 une convention collective, un fonds de licenciement peut \u00eatre convenu avec le syndicat. Personne physique, le Travailleur Ind\u00e9pendant peut embaucher jusqu&rsquo;\u00e0 trois collaborateurs ind\u00e9pendants pour travailler sur une entreprise commune. En vertu de l\u2019ancienne loi, ces personnes auraient probablement \u00e9t\u00e9 consid\u00e9r\u00e9es comme des \u201cemploy\u00e9s\u201d. Par exemple :<\/p>\n<p>&#8211; L\u2019exigence d\u2019audits ind\u00e9pendants concernant les r\u00e9gimes de soins de sant\u00e9 syndicaux financ\u00e9s par les contributions des employeurs et des employ\u00e9s.<\/p>\n<p>&#8211; L\u2019\u00e9limination du monopole des syndicats bas\u00e9 sur l\u2019industrie et l\u2019activit\u00e9 des employeurs, permettant aux syndicats d\u2019\u00eatre en concurrence pour l\u2019affiliation des travailleurs.<\/p>\n<p>La <em>Ley de Bases<\/em> est clairement un test pour \u00e9valuer la volont\u00e9 du public et des politiciens de permettre aux r\u00e9formes du libre march\u00e9 de s\u2019installer.
