Ces changements affectent les contrats de location, tant \u00e0 usag d&rsquo;habitation qu\u2019\u00e0 usage commercial.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbLibert\u00e9 Contractuelle\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]Les parties sont d\u00e9sormais libres de d\u00e9terminer les conditions du contrat de location.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbDur\u00e9e\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]La dur\u00e9e des contrats de location, quel que soit leur objet, est d\u00e9termin\u00e9e par les parties. Le DNU ne fournit des directives sp\u00e9cifiques que pour les cas o\u00f9 aucune dur\u00e9e n&rsquo;a \u00e9t\u00e9 d\u00e9finie :<\/p>\n<ul>\n<li>Dans les locations temporaires, la dur\u00e9e est r\u00e9gie par les usages et coutumes locaux du lieu o\u00f9 se trouve le bien immobilier objet du contrat de location.<\/li>\n<li>Pour les contrats destin\u00e9s \u00e0 l&rsquo;habitation permanente, la dur\u00e9e est de deux (2) ans, tandis que pour les autres destinations, elle est fix\u00e9e \u00e0 trois (3) ans.<\/li>\n<\/ul>\n<p>[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbMonnaie de Paiement du Loyer\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]Le DNU \u00e9tablit que l&rsquo;obligation consiste \u00e0 payer de l&rsquo;argent lorsque le d\u00e9biteur doit une quantit\u00e9 sp\u00e9cifique d\u2019une monnaie, qu&rsquo;elle ait ou non cours l\u00e9gal dans le pays, au moment de la cr\u00e9ation de l&rsquo;obligation. Il est donc d\u00e9sormais possible de convenir de loyers en dollars ou dans une autre monnaie \u00e9trang\u00e8re sans risque.<\/p>\n<p>Le d\u00e9biteur ne sera lib\u00e9r\u00e9 qu&rsquo;en payant dans ladite monnaie et ne pourra pr\u00e9tendre payer en pesos au taux de change officiel, sauf si cela a \u00e9t\u00e9 express\u00e9ment convenu. De plus, le DNU stipule que les juges ne peuvent modifier la forme de paiement ou la monnaie convenue.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbIndexation\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]Les parties ont d\u00e9sormais la facult\u00e9 de convenir de l\u2019indexation du montant du loyer. Tout indice peut \u00eatre utilis\u00e9, qu&rsquo;il soit public ou priv\u00e9, \u00e0 condition qu&rsquo;il soit libell\u00e9 dans la m\u00eame monnaie que celle convenue pour le montant du loyer.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbFr\u00e9quence de Paiement du Loyer\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]Les parties sont libres de convenir librement de la fr\u00e9quence de paiement du loyer, bien que le DNU stipule que la p\u00e9riodicit\u00e9 ne peut \u00eatre inf\u00e9rieure \u00e0 un (1) mois.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbCaution ou D\u00e9p\u00f4t de Garantie\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]Le DNU laisse aux parties la libert\u00e9 de convenir du montant et de la monnaie de la caution ou du d\u00e9p\u00f4t de garantie, ainsi que des modalit\u00e9s de remboursement \u00e0 la fin du contrat de location.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbR\u00e9siliation du Contrat\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]Le bailleur peut r\u00e9silier le contrat pour : (i) changement de destination ou usage irr\u00e9gulier du bien immobilier ; (ii) d\u00e9faut d&rsquo;entretien de la chose lou\u00e9e ou abandon ; (iii) non-paiement du loyer pendant deux (2) p\u00e9riodes cons\u00e9cutives ; (iv) toute cause fix\u00e9e dans le contrat.<\/p>\n<p>Le locataire peut r\u00e9silier le contrat en cas de (i) manquement du bailleur \u00e0 son obligation de maintenir le bien immobilier apte \u00e0 l&rsquo;usage et \u00e0 la jouissance convenus &#8211; \u00e0 moins que le dommage ne soit caus\u00e9 directement ou indirectement par le locataire -, et (ii) manquement \u00e0 la garantie d&rsquo;\u00e9viction ou aux vices r\u00e9dhibitoires.<\/p>\n<p>Le DNU pr\u00e9voit la possibilit\u00e9 d&rsquo;une r\u00e9siliation anticip\u00e9e du contrat par le locataire \u00e0 tout moment (auparavant, cela n&rsquo;\u00e9tait possible qu&rsquo;apr\u00e8s les six premiers mois).
