La Loi sur les Terres Rurales comprenait notamment les points suivants :<\/p>\n<ul>\n<li><strong>Limites \u00e0 la propri\u00e9t\u00e9 \u00e9trang\u00e8re : pas plus de 15 % des terres rurales de l&rsquo;ensemble du pays pouvaient \u00eatre d\u00e9tenues ou poss\u00e9d\u00e9es par des \u00e9trangers, y compris des entit\u00e9s juridiques d\u00e9tenues ou contr\u00f4l\u00e9es par des \u00e9trangers.<\/strong><\/li>\n<li><strong>Quotas de nationalit\u00e9 : sur les 15 % \u00e0 l&rsquo;\u00e9chelle nationale, pas plus de 30 % pouvaient \u00eatre de la m\u00eame nationalit\u00e9.<\/strong><\/li>\n<li><strong>Limites de possession fonci\u00e8re : La Loi sur les Terres Rurales identifiait certaines \u00ab\u00a0zones centrales\u00a0\u00bb g\u00e9ographiques (comme la c\u00e9l\u00e8bre <em>Pampa H\u00fameda<\/em> de l&rsquo;Argentine, cruciale pour l&rsquo;approvisionnement alimentaire) et limitait la propri\u00e9t\u00e9 des personnes \u00e9trang\u00e8res individuelles \u00e0 1 000 hectares dans la zone centrale concern\u00e9e.<\/strong><\/li>\n<li><strong>Restrictions aux fronti\u00e8res et aux ressources en eau \u00a0: Aucun \u00e9tranger ne pouvait poss\u00e9der des terres c\u00f4ti\u00e8res, des propri\u00e9t\u00e9s situ\u00e9es le long d&rsquo;une fronti\u00e8re nationale, ou des propri\u00e9t\u00e9s adjacentes ou au-dessus d&rsquo;un grand plan d&rsquo;eau.<\/strong><\/li>\n<\/ul>\n<p>Au fil des ann\u00e9es, la Loi sur les Terres Rurales a subi plusieurs modifications, devenant parfois plus restrictive sous certains gouvernements et moins restrictive sous d&rsquo;autres, en fonction de leur perspective sur l&rsquo;investissement direct \u00e9tranger.<\/p>\n<p>N\u00e9anmoins, pendant plus de 12 ans, la loi a d\u00e9courag\u00e9 l&rsquo;investissement dans les zones rurales de l&rsquo;Argentine et a incit\u00e9 \u00e0 la mise en place de structures financi\u00e8res et soci\u00e9taires complexes pour satisfaire la loi.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbAbrogation de la Loi sur les Terres Rurales\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]Le DNU abroge la Loi sur les Terres Rurales dans son int\u00e9gralit\u00e9. L&rsquo;administration Milei a d\u00e9clar\u00e9 que la \u00ab\u00a0libert\u00e9 contractuelle\u00a0\u00bb s&rsquo;applique aux acquisitions de biens immobiliers et que toutes les personnes, y compris les \u00e9trangers, ne devraient pas rencontrer de restrictions quant \u00e0 la superficie, l&#8217;emplacement, les conditions ou la nationalit\u00e9 lorsqu&rsquo;elles cherchent \u00e0 investir en Argentine.<\/p>\n<p>L&rsquo;abrogation de la Loi sur les Terres Rurales par le DNU repose sur le principe de l&rsquo;\u00e9galit\u00e9 de protection devant la loi de la Constitution argentine, applicable tant aux citoyens qu&rsquo;aux non-citoyens de la m\u00eame fa\u00e7on.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbValidit\u00e9 et efficacit\u00e9 du DNU\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]Le DNU est entr\u00e9 en vigueur le 29 d\u00e9cembre. Ensuite, le chef de cabinet du pr\u00e9sident a 10 jours pour soumettre le DNU \u00e0 une commission bicam\u00e9rale du Congr\u00e8s pour examen et avis.<\/p>\n<p>La commission a 10 jours pour recommander l&rsquo;approbation ou le rejet de l&rsquo;ensemble du d\u00e9cret pr\u00e9sidentiel. Suite \u00e0 l\u2019avis de la commission, ou en son absence, les deux chambres l\u00e9gislatives (S\u00e9nat et Chambre des Repr\u00e9sentants) doivent voter pour accepter ou rejeter le d\u00e9cret pr\u00e9sidentiel.<\/p>\n<p>Comme pour l\u2019avis de la commission, le vote porte sur l&rsquo;ensemble du DNU ; il ne peut \u00eatre partiellement approuv\u00e9 ou rejet\u00e9. <strong>Si l&rsquo;une des chambres l&rsquo;approuve, le d\u00e9cret pr\u00e9sidentiel est adopt\u00e9 et a \u00ab\u00a0force de loi\u00a0\u00bb.<\/strong> En revanche, <strong>si les deux chambres le rejettent, le DNU est nul dans son int\u00e9gralit\u00e9<\/strong>, mais tous les actes effectu\u00e9s en se fondant sur le DNU pendant sa validit\u00e9 restent valables et contraignants.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbPlus sur le D\u00e9cret d&rsquo;Urgence 70\/23&Prime; use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]Au cours des 10 derniers jours, nous avons couvert divers aspects du D\u00e9cret d&rsquo;Urgence 70\/23 (le \u00ab\u00a0DNU\u00a0\u00bb) \u00e9mis par le pr\u00e9sident Javier Milei.
