D\u00e9cret 70\/23<\/strong><\/span><\/h1>\n<h2>Quel est l&rsquo;impact du m\u00e9ga d\u00e9cret 70\/23 du Pr\u00e9sident Milei sur le droit du travail ?<\/h2>\n<p>Le 20 d\u00e9cembre 2023, le pr\u00e9sident Javier Milei a \u00e9mis le d\u00e9cret 70\/23 de n\u00e9cessit\u00e9 et d&rsquo;urgence (le \u00ab\u00a0DNU\u00a0\u00bb), qui modifie, avec cette tentative de r\u00e9forme, d&rsquo;importants aspects du droit du travail entre autres choses. Le DNU s&rsquo;applique \u00e0 tous les contrats de travail existants.<\/p>\n<p>Voyons les points les plus importants.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbEnregistrement des contrats de travail\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]Le DNU modernise et facilite l&rsquo;enregistrement des contrats de travail, dont les nouvelles conditions seront \u00e9tablies par le pouvoir ex\u00e9cutif, et dont on sait d\u00e9j\u00e0 qu\u2019il se fera par voie \u00e9lectronique.<\/p>\n<p>Ces mesures, qui visent \u00e0 faciliter l&rsquo;enregistrement, vont de pair avec l&rsquo;abrogation de toutes les sanctions en cas de d\u00e9faut d&rsquo;enregistrement. Ainsi, il n&rsquo;y aura plus d\u2019indemnisation aggrav\u00e9e pour le d\u00e9faut d\u2019enregistrement.\u00a0Le DNU a \u00e9galement abrog\u00e9 l&rsquo;indemnit\u00e9 aggrav\u00e9e en cas de d\u00e9faut d&rsquo;enregistrement dans le cadre du r\u00e9gime sp\u00e9cial des contrats de travail des travailleurs domestiques.<\/p>\n<p>Parmi les amendes supprim\u00e9es, il y a \u00e9galement celles qui \u00e9tait pr\u00e9vue en cas de d\u00e9faut de d\u00e9livrance, en temps et dans les formes pr\u00e9vues, de la certification de services, qui \u00e9quivalaient \u00e0 trois salaires. La nouveaut\u00e9 r\u00e9side \u00e9galement dans le fait que la d\u00e9livrance de la certification de services se fera par l&rsquo;interm\u00e9diaire d&rsquo;une plateforme virtuelle.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbRetenues Salariales\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]La r\u00e9forme du droit du travail \u00e9tablit que l&#8217;employeur ne sera plus oblig\u00e9 de retenir sur le salaire du travailleur les cotisations, droits ou contributions que les travailleurs seraient oblig\u00e9s de payer en raison de leur appartenance \u00e0 des associations syndicales, sauf avec leur consentement expr\u00e8s.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbP\u00e9riode d&rsquo;essai\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]La DNU 70\/23 <strong>a \u00e9tendu la p\u00e9riode d&rsquo;essai de 3 \u00e0 8 mois<\/strong>, et les parties peuvent mettre fin au contrat de travail, durant cette p\u00e9riode, sans obligation de verser une indemnit\u00e9.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbT\u00e9l\u00e9travail\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]Dans le cas o\u00f9 le salari\u00e9 a demand\u00e9 ou consenti \u00e0 travailler \u00e0 distance, il peut y \u00eatre mis fin d&rsquo;un commun accord &#8211; dans la mesure o\u00f9 les conditions de retour existent dans les installations &#8211; ou en fonction des besoins de chaque poste.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbCompensation pour anciennet\u00e9\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]La r\u00e9forme du droit du travail modifie le calcul de l&rsquo;indemnit\u00e9 d&rsquo;anciennet\u00e9 en adoptant des crit\u00e8res jurisprudentiels diff\u00e9rents, <strong>tant en ce qui concerne la base de calcul que le plafond applicable<\/strong>.<\/p>\n<p>La base de calcul sur laquelle l&rsquo;indemnit\u00e9 d&rsquo;anciennet\u00e9 doit \u00eatre calcul\u00e9e n&rsquo;inclut pas la prime de No\u00ebl, des primes et\/ou de tout autre concept de paiement semestriel ou annuel.<\/p>\n<p>Le DNU reprend ainsi un crit\u00e8re jurisprudentiel qui \u00e9tait en train de s\u2019esquisser dans la Capitale f\u00e9d\u00e9rale, mais il le fait de mani\u00e8re plus large et plus forte en ce qui concerne l\u2019exclusion des primes et les paiements semestriels et annuels.<\/p>\n<p>Dans le cas des r\u00e9mun\u00e9rations variables, la base de calcul mensuelle sera d\u00e9termin\u00e9e en fonction de la moyenne des 6 ou 12 derniers mois -selon ce qui est le plus favorable au travailleur-. De cette mani\u00e8re, une doctrine judiciaire qui \u00e9tait d&rsquo;application obligatoire dans la Capitale f\u00e9d\u00e9rale est modifi\u00e9e.<\/p>\n<p>Enfin, la base de calcul suit l&rsquo;ancien plafond, mais incorpore comme nouveaut\u00e9 la doctrine de la Cour supr\u00eame de justice de la Nation dans l&rsquo;affaire \u00ab\u00a0Vizzoti\u00a0\u00bb, raison pour laquelle la base de calcul susmentionn\u00e9e ne peut \u00eatre inf\u00e9rieure \u00e0 67 % du montant \u00e9quivalent \u00e0 un mois de salaire.<\/p>\n<p>Au syst\u00e8me d\u00e9j\u00e0 classique d&rsquo;indemnit\u00e9s de licenciement, le DNU a ajout\u00e9 un syst\u00e8me alternatif qui peut \u00eatre mis en place par une convention collective, consistant en un fonds ou un syst\u00e8me d&rsquo;indemnit\u00e9s de licenciement, dont le co\u00fbt sera toujours support\u00e9 par l&#8217;employeur, avec une contribution mensuelle qui ne peut pas d\u00e9passer 8 % de la r\u00e9mun\u00e9ration calculable.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbNouveaux motifs de licenciement\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]Gr\u00e2ce \u00e0 une technique l\u00e9gislative in\u00e9dite, le d\u00e9cret 70\/23 incorpore comme motif sp\u00e9cifique de licenciement la participation \u00e0 des blocages ou \u00e0 des <strong>prises de contr\u00f4le d&rsquo;\u00e9tablissements<\/strong>.<\/p>\n<p>Cette cause de licenciement ne d\u00e9pendra pas de l&rsquo;appr\u00e9ciation d&rsquo;un juge, mais d&rsquo;un fait objectif, d\u00e9crit dans la norme.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbLicenciement Discriminatoire\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]Le concept du licenciement discriminatoire est incorpor\u00e9, y compris pour des raisons syndicales, de mani\u00e8re exhaustive, en \u00e9tablissant une indemnit\u00e9 aggrav\u00e9e comprise entre 50 et 100 % de l&rsquo;\u00e9quivalent de l&rsquo;indemnit\u00e9 d&rsquo;anciennet\u00e9.<\/p>\n<p>Il est int\u00e9ressant de noter que le DNU est clair en ce sens qu&rsquo;il donne pleine validit\u00e9 au licenciement, m\u00eame s&rsquo;il est discriminatoire, de sorte <strong>qu&rsquo;il n&rsquo;y a pas de place pour la r\u00e9int\u00e9gration du travailleur, comme c&rsquo;\u00e9tait le cas auparavant.<\/strong>[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbFrais de justice\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]<strong>Les frais de justice en mati\u00e8re de droit du travail sont sensiblement r\u00e9duits<\/strong>, car le DNU pr\u00e9voitque :<\/p>\n<ul>\n<li>Les amendes pour d\u00e9faut d&rsquo;enregistrement sont \u00e9limin\u00e9es.<\/li>\n<li>L&rsquo;aggravation de l&rsquo;indemnisation en cas de r\u00e9clamation judiciaire est \u00e9limin\u00e9e.<\/li>\n<li>Le taux d&rsquo;int\u00e9r\u00eat qui peut \u00eatre appliqu\u00e9 par les tribunaux est limit\u00e9.<\/li>\n<\/ul>\n<p>En ce sens, <strong>le taux d&rsquo;int\u00e9r\u00eat ne peut \u00eatre sup\u00e9rieur \u00e0 l&rsquo;indice des prix \u00e0 la consommation (IPC), major\u00e9 d&rsquo;un taux d&rsquo;int\u00e9r\u00eat net de 3 %.<\/strong><\/p>\n<p>Ce dernier point est tr\u00e8s int\u00e9ressant, car dans certaines juridictions, les juges appliquent des crit\u00e8res d&rsquo;actualisation discr\u00e9tionnaires qui d\u00e9passent largement l&rsquo;inflation, et les condamnations atteignent des sommes astronomiques dont le paiement met en p\u00e9ril la viabilit\u00e9 \u00e9conomique des entreprises.<\/p>\n<p>Enfin, en cas de condamnation judiciaire, <strong>tant les particuliers que les PME pourront b\u00e9n\u00e9ficier du paiement int\u00e9gral de l&rsquo;indemnit\u00e9 en 12 mensualit\u00e9s cons\u00e9cutives au maximum<\/strong>, qui seront r\u00e9vis\u00e9es selon l&rsquo;indice CPI major\u00e9 de 3 % par an.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbTravailleurs Ind\u00e9pendants. Mod\u00e9ration de la Relation de D\u00e9pendance\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]La figure du <strong>Travailleur ind\u00e9pendant est incorpor\u00e9e, qui peut engager jusqu&rsquo;\u00e0 5 collaborateurs ind\u00e9pendants<\/strong> pour d\u00e9velopper une entreprise productive et fournir des services.<\/p>\n<p>Ces travailleurs ind\u00e9pendants seront exclus de la loi sur les contrats de travail et seront r\u00e9gis par un r\u00e9gime diff\u00e9rent \u00e0 r\u00e9glementer.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbGr\u00e8ve\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]Le D\u00e9cret 70\/23 \u00e9largit l&rsquo;\u00e9ventail des activit\u00e9s pour lesquelles un service minimum doit \u00eatre garanti pendant la gr\u00e8ve.<\/p>\n<p>\u00c0 cet effet, \u00e0 la classification d\u00e9j\u00e0 connue des \u00ab\u00a0services essentiels\u00a0\u00bb, le DNU <strong>ajoute<\/strong> les \u00ab\u00a0<strong>services d&rsquo;importance transcendantale<\/strong>\u00ab\u00a0.<\/p>\n<p>Dans la cat\u00e9gorie des services essentiels, qui est consid\u00e9rablement \u00e9largie, sont incorpor\u00e9s, entre autres :<\/p>\n<ul>\n<li>L&rsquo;\u00e9ducation jusqu&rsquo;au niveau secondaire<\/li>\n<li>Les services de t\u00e9l\u00e9communications, et<\/li>\n<li>Le transport de carburant.<\/li>\n<\/ul>\n<p>La DNU \u00e9tablit que <strong>la fourniture de services minimaux ne peut \u00eatre inf\u00e9rieure \u00e0 75 %<\/strong> de la fourniture normale du service en question.<\/p>\n<p>La cat\u00e9gorie des <strong>Services d&rsquo;Importance Transcendantale<\/strong> comprend, entre autres :<\/p>\n<ul>\n<li>La production de fournitures hospitali\u00e8res,<\/li>\n<li>Les transports maritimes, a\u00e9riens, fluviaux, terrestres et souterrains de personnes et\/ou de marchandises,<\/li>\n<li>Les activit\u00e9s industrielles continues &#8211; y compris la production de fer, d&rsquo;acier et d&rsquo;aluminium, l&rsquo;activit\u00e9 chimique et l&rsquo;activit\u00e9 cimenti\u00e8re,<\/li>\n<li>L&rsquo;industrie alimentaire dans toute sa cha\u00eene de valeur,<\/li>\n<li>La production de mat\u00e9riaux de construction,<\/li>\n<li>Les services bancaires, h\u00f4teliers et gastronomiques.<\/li>\n<\/ul>\n<p>Pour cette cat\u00e9gorie de Services d&rsquo;Importance Transcendantale, le D\u00e9cret 70\/23 \u00e9tablit que la prestation de services minimaux <strong>ne peut \u00eatre inf\u00e9rieure \u00e0 50 % de la prestation normale<\/strong> du service en question.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbValidit\u00e9 et mise en \u0153uvre du D\u00e9cret70\/23&Prime; use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]<\/p>\n<h3>Validit\u00e9 du D\u00e9cret 70\/23<\/h3>\n<p>Le DNU entre en vigueur le 29 d\u00e9cembre 2023. Le Chef de Cabinet dispose de 10 jours pour le soumettre \u00e0 l&rsquo;examen de la Commission Bicam\u00e9rale du Congr\u00e8s.
