Nos clients nous consultent fr\u00e9quemment sur les modalit\u00e9s du travail \u00e0 distance et nous avons pens\u00e9 que ce guide serait une premi\u00e8re \u00e9tape utile pour comprendre et planifier certains risques qui peuvent ne pas \u00eatre \u00e9vidents \u00e0 premi\u00e8re vue.<\/p>\n<p>Le faible co\u00fbt de la vie dans une ville cosmopolite et dynamique, situ\u00e9e dans un fuseau horaire privil\u00e9gi\u00e9, s\u00e9duit \u00e0 la fois le salari\u00e9 et l&#8217;employeur. Le freelance individuel &#8211; appel\u00e9 \u00ab\u00a0nomade num\u00e9rique\u00a0\u00bb &#8211; qui re\u00e7oit des paiements en esp\u00e8ces, en crypto-monnaie ou sur un compte bancaire \u00e9tranger et qui reste \u00ab\u00a0sous le radar\u00a0\u00bb ne pense peut-\u00eatre pas \u00e0 autre chose qu&rsquo;\u00e0 entrer dans le pays avec un \u00ab\u00a0visa de nomade num\u00e9rique\u00a0\u00bb r\u00e9cemment cr\u00e9\u00e9, qui permet \u00e0 son d\u00e9tenteur de travailler depuis l&rsquo;Argentine jusqu&rsquo;\u00e0 180 jours (avec le droit de prolonger une fois pour un m\u00eame nombre de jours) et de s&rsquo;assurer d&rsquo;avoir une couverture m\u00e9dicale internationale. Mais pour l&#8217;employeur multinational qui cherche \u00e0 se mettre en conformit\u00e9 \u00e0 l&rsquo;\u00e9chelle mondiale, l&rsquo;organisation du travail \u00e0 distance pour ses salari\u00e9s devient chaque jour plus plus complexe. Si un demandeur affirme qu&rsquo;il \u00e9tait un salari\u00e9 argentin, il incombe au d\u00e9fendeur de prouver qu&rsquo;il ne l&rsquo;\u00e9tait pas. Si l&#8217;employ\u00e9 a travaill\u00e9 pendant une p\u00e9riode prolong\u00e9e en Argentine, la loi consid\u00e8re g\u00e9n\u00e9ralement qu&rsquo;il s&rsquo;agit d&rsquo;un emploi argentin <em>de facto<\/em> qui aurait d\u00fb \u00eatre d\u00e9clar\u00e9.\u00a0 Le d\u00e9faut de d\u00e9claration expose l&#8217;employeur \u00e0 des sanctions potentiellement importantes.<\/p>\n<p>En r\u00e8gle g\u00e9n\u00e9rale, aucun salari\u00e9 \u00e0 distance ne souhaite \u00eatre un salari\u00e9 argentin, ce qui impliquerait de payer l&rsquo;imp\u00f4t sur le revenu argentin et, \u00e9ventuellement, des charges sociales, et probablement de gagner de l&rsquo;argent dans la monnaie locale. Toutefois, ce sentiment change souvent rapidement lorsque l&#8217;emploi prend fin. \u00c0 ce moment-l\u00e0, les r\u00e8gles statutaires argentines en mati\u00e8re d&rsquo;indemnit\u00e9s de licenciement (un mois complet de salaire pour chaque ann\u00e9e de service) et les amendes payables au plaignant incitent fortement \u00e0 intenter une action en justice. Cela surprend souvent les employeurs \u00e9trangers habitu\u00e9s aux r\u00e8gles de l&#8217;emploi volontaire.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbTravail \u00e0 distance de courte dur\u00e9e\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]Dans le cas d&rsquo;un contrat \u00e0 distance de courte dur\u00e9e, le risque d&rsquo;une relation de travail de facto en Argentine est n\u00e9gligeable, voire inexistant. Les salari\u00e9s qui viennent travailler pour leur employeur pendant une semaine ou deux ne posent pas de probl\u00e8mes de non-conformit\u00e9 avec le droit du travail argentin et ne constituent pas non plus une base cr\u00e9dible permettant au salari\u00e9 de revendiquer un licenciement et d&rsquo;autres avantages li\u00e9s \u00e0 l&#8217;emploi en vertu du droit du travail argentin.\u00a0 Pour ces personnes, il n&rsquo;est pas n\u00e9cessaire de d\u00e9clarer le salari\u00e9 en Argentine ou d&rsquo;obtenir un visa de travail pour un salari\u00e9 souhaitant travailler quelques semaines en Argentine. L&rsquo;analyse devient beaucoup plus nuanc\u00e9e si l&rsquo;arrangement se prolonge. Malheureusement, il n&rsquo;existe pas d&rsquo;orientation statutaire permettant de d\u00e9terminer avec certitude \u00e0 quel moment, dans le temps, un accord est soumis au droit argentin. Au-del\u00e0 d&rsquo;un mois, un risque au moins hypoth\u00e9tique commence \u00e0 poindre.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbR\u00e9flexions fiscales pour le t\u00e9l\u00e9travail en Argentine\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]En vertu des r\u00e8gles fiscales actuelles, les r\u00e9sidents \u00e9trangers sont soumis \u00e0 un imp\u00f4t de 35 % sur leurs revenus en Argentine. Si cette personne fournit des services pendant plus de six mois depuis l&rsquo;Argentine au profit d&rsquo;un employeur non argentin, l&#8217;employeur \u00e9tranger s&rsquo;expose \u00e0 un risque de plus en plus important d&rsquo;\u00eatre consid\u00e9r\u00e9 comme un \u00e9tablissement permanent en Argentine. Dans ce cas, le revenu net de l&#8217;employeur provenant de sources argentines et \u00e9trang\u00e8res devrait \u00eatre impos\u00e9 en Argentine.<\/p>\n<p>Revenons un instant \u00e0 au salari\u00e9 \u00e0 distance bas\u00e9 en Argentine. Cette personne devient r\u00e9sident fiscal lorsqu&rsquo;elle acquiert la r\u00e9sidence permanente ou apr\u00e8s un s\u00e9jour de 12 mois non interrompu par des absences de 90 jours ou moins. D\u00e8s qu&rsquo;il devient r\u00e9sident fiscal, le salari\u00e9 \u00e0 distanceest assujetti \u00e0 l&rsquo;imp\u00f4t argentin sur les revenus mondiaux &#8211; sous r\u00e9serve de toute convention de double imposition applicable &#8211; et \u00e0 un imp\u00f4t sur le patrimoine (\u00ab\u00a0biens personnels\u00a0\u00bb) sur tous les biens d\u00e9tenus dans le monde[1].<\/p>\n<p>Une fois que le salari\u00e9 \u00e0 distance reste suffisamment longtemps pour \u00eatre consid\u00e9r\u00e9 comme un salari\u00e9 \u00ab\u00a0argentin\u00a0\u00bb (qui n&rsquo;est <u>pas<\/u> d\u00e9fini par les crit\u00e8res de r\u00e9sidence fiscale du paragraphe pr\u00e9c\u00e9dent), cette personne (et son employeur) doit payer l&rsquo;imp\u00f4t sur le revenu et, tr\u00e8s probablement, les cotisations de s\u00e9curit\u00e9 sociale \u00e0 l&rsquo;Argentine. L&rsquo;imp\u00f4t sur le revenu doit \u00eatre retenu par l&#8217;employeur \u00e0 un taux progressif allant de 5 % \u00e0 35 % plus une somme ascendante.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbAttention aux employeurs\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text]Le gouvernement argentin est confront\u00e9 \u00e0 un d\u00e9fi complexe concernant les cons\u00e9quences fiscales des employeurs <em>offshore<\/em> et des salari\u00e9s \u00e0 distance. \u00c0 moins que le salari\u00e9 \u00e9tranger ne se voie attribuer un num\u00e9ro d&rsquo;identification gouvernemental et un num\u00e9ro d&rsquo;imp\u00f4t f\u00e9d\u00e9ral, il est difficile de r\u00e9glementer et de percevoir des imp\u00f4ts dans le cadre de cet arrangement. N\u00e9anmoins, les gouvernements sont en train de rattraper le monde num\u00e9rique \u00e0 bien des \u00e9gards.<\/p>\n<p>Afin d&rsquo;encourager la r\u00e9mun\u00e9ration locale des salari\u00e9s du secteur technologique, le gouvernement argentin propose actuellement une initiative l\u00e9gislative visant \u00e0 cr\u00e9er un \u00ab\u00a0imp\u00f4t forfaitaire sur la technologie\u00a0\u00bb (<em>Monotributo Tech<\/em>). Cet imp\u00f4t viserait sp\u00e9cifiquement les professionnels de la technologie et les <em>gamers<\/em> travaillant dans le d\u00e9veloppement de logiciels, les services professionnels, la biotechnologie, la nanotechnologie et l&rsquo;industrie audiovisuelle. L&rsquo;initiative vise \u00e0 mettre les entreprises nationales sur un pied d&rsquo;\u00e9galit\u00e9 avec les concurrents \u00e9trangers qui offrent des salaires plus \u00e9lev\u00e9s. L&rsquo;initiative propose \u00e9galement un syst\u00e8me d&rsquo;imposition sp\u00e9cial sur les salaires des personnes travaillant pour ces entreprises \u00e9trang\u00e8res en Argentine.<\/p>\n<p>Entretemps, les employeurs \u00e9trangers doivent veiller \u00e0 ne pas cr\u00e9er une relation de travail de facto en Argentine, ce qui pourrait repr\u00e9senter un risque important &#8211; souvent \u00e0 leur insu &#8211; pour l&#8217;employeur.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbNotes de bas de page\u00a0\u00bb font_container=\u00a0\u00bbtag:h3|text_align:left\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text][1] L&rsquo;imp\u00f4t sur le patrimoine des particuliers est pr\u00e9lev\u00e9 au 31 d\u00e9cembre de chaque ann\u00e9e \u00e0 un taux progressif allant de 0,5 % \u00e0 1,75 % (0,7 % \u00e0 2,25 % pour les participations financi\u00e8res) plus une somme ascendante sur le total des actifs d\u00e9passant un montant d\u00e9termin\u00e9.
