L\u2019abrogation de la Loi sur le T\u00e9l\u00e9travail et son impact sur les relations de travail\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb css=\u00a0\u00bb\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text css=\u00a0\u00bb\u00a0\u00bb]Le <strong>Projet de Loi de Modernisation du Travail<\/strong>, actuellement en d\u00e9bat, propose l\u2019abrogation de la <strong>Loi sur le T\u00e9l\u00e9travail n\u00b0 27.555<\/strong>. Cette initiative soul\u00e8ve une question essentielle dans un contexte o\u00f9 le travail \u00e0 distance \u2014 et notamment les mod\u00e8les hybrides \u2014 fait d\u00e9sormais partie int\u00e9grante de l\u2019organisation des entreprises, de la gestion des ressources humaines et de la comp\u00e9titivit\u00e9 des offres de travail, en particulier dans les soci\u00e9t\u00e9s \u00e0 port\u00e9e r\u00e9gionale ou internationale.<\/p>\n<p>La suppression \u00e9ventuelle de ce cadre juridique introduit une <strong>incertitude juridique<\/strong>. Comme lors de pr\u00e9c\u00e9dentes r\u00e9formes du droit du travail en Argentine, il est probable que la jurisprudence \u2014 et en dernier ressort la Cour Supr\u00eame argentine \u2014 d\u00e9finisse les contours du nouveau r\u00e9gime. Cependant, il ne faut pas oublier que les juridictions prud\u2019homales en Argentine ne s\u2019illustrent ni par leur rapidit\u00e9 ni par leur pr\u00e9visibilit\u00e9 face aux changements l\u00e9gislatifs, ce qui pourrait entra\u00eener une p\u00e9riode prolong\u00e9e d\u2019h\u00e9sitation.<\/p>\n<p>Dans ce contexte, des questions in\u00e9vitables se posent pour les employeurs et les d\u00e9partements RRHH : Faudra-t-il maintenir les conditions et droits reconnus sous la Loi sur le T\u00e9l\u00e9travail ? Pourra-t-il exister diff\u00e9rents r\u00e9gimes applicables aux salari\u00e9s faisant du t\u00e9l\u00e9travail au sein d\u2019une m\u00eame organisation ?<\/p>\n<p>Une premi\u00e8re analyse permet d\u2019anticiper qu\u2019en cas d\u2019abrogation, <strong>certains droits et obligations ne seraient plus en vigueur faute de r\u00e9glementation sp\u00e9cifique<\/strong>, tandis que d\u2019autres resteraient couverts par les normes g\u00e9n\u00e9rales du droit du travail.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbLes droits et obligations qui dispara\u00eetraient\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb css=\u00a0\u00bb\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text css=\u00a0\u00bb\u00a0\u00bb]Sans r\u00e9glementation sp\u00e9cifique, les droits introduits par la Loi sur le T\u00e9l\u00e9travail ne seraient plus express\u00e9ment reconnus, parmi lesquels :<\/p>\n<ul>\n<li>La reconnaissance des \u00ab\u00a0<strong>t\u00e2ches de soin\u00a0<\/strong>\u00bb (\u00ab\u00a0<em>tareas de cuidado<\/em>\u00a0\u00bb) du salari\u00e9. La Loi sur le T\u00e9l\u00e9travail oblige l\u2019employeur \u00e0 rendre compatibles les horaires de travail avec les \u00ab\u00a0t\u00e2ches de soin\u00a0\u00bb pesant sur les salari\u00e9s justifiant avoir \u00e0 charge un mineur de moins de 13 ans, une personne \u00e2g\u00e9e ou une personne en situation de handicap.<\/li>\n<li>Le droit \u00e0 la <strong>r\u00e9versibilit\u00e9<\/strong> vers le travail en pr\u00e9sentiel par la seule d\u00e9cision du salari\u00e9 et l\u2019obligation corr\u00e9lative de l\u2019employeur d\u2019assigner des t\u00e2ches en pr\u00e9sentiel.<\/li>\n<li>L\u2019obligation pour l\u2019employeur de fournir, maintenir et r\u00e9parer <strong>les \u00e9quipements de travail<\/strong>, sans pr\u00e9judice des exigences minimales en mati\u00e8re de pr\u00e9vention des risques professionnels.<\/li>\n<li>L\u2019obligation de compenser les <strong>frais suppl\u00e9mentaires de connexion<\/strong>, consommation de services et autres co\u00fbts li\u00e9s au t\u00e9l\u00e9travail, sans pr\u00e9judice de l\u2019obligation g\u00e9n\u00e9rale de remboursement des frais support\u00e9s par le salari\u00e9 et l\u2019indemnisation des dommages caus\u00e9s \u00e0 ses biens en raison de l\u2019accomplissement de son travail.<\/li>\n<li>La pr\u00e9somption que les <strong>accidents<\/strong> survenus sur le lieu, pendant la journ\u00e9e et \u00e0 l\u2019occasion du t\u00e9l\u00e9travail soient consid\u00e9r\u00e9s comme des accidents du travail.<\/li>\n<li>L\u2019obligation pour l\u2019employeur d\u2019inscrire dans le <strong>Registre du T\u00e9l\u00e9travail<\/strong> (\u00ab\u00a0<em>Registro del Teletrabajo<\/em>\u00a0\u00bb) les salari\u00e9s travaillant selon cette modalit\u00e9.<\/li>\n<\/ul>\n<p>Cela ne signifie pas pour autant que le t\u00e9l\u00e9travail serait totalement d\u00e9pourvu de protection juridique. <strong>De nombreux droits, garanties et obligations resteraient pleinement en vigueur<\/strong> gr\u00e2ce au cadre juridique complexe applicable aux relations de travail, compos\u00e9 de normes nationales, internationales, jurisprudence et interpr\u00e9tations d\u2019organismes supranationaux. Parmi ces droits figurent le principe d\u2019\u00e9galit\u00e9 de r\u00e9mun\u00e9ration \u00e0 t\u00e2ches \u00e9gales, les limites \u00e0 la journ\u00e9e de travail, les facult\u00e9s de contr\u00f4le de l\u2019employeur et la protection de la vie priv\u00e9e du salari\u00e9.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbConsid\u00e9rations finales\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb css=\u00a0\u00bb\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text css=\u00a0\u00bb\u00a0\u00bb]Le travail \u00e0 distance est l\u00e0 pour rester. Dans ce contexte, l\u2019abrogation d\u2019une loi qui le r\u00e9gule \u2014 sans texte de remplacement \u2014 <strong>n\u2019apporte pas de r\u00e8gles claires pour les acteurs concern\u00e9s<\/strong>, ni pour les travailleurs ni pour les employeurs.<\/p>\n<p>D\u2019un point de vue pratique, une <strong>r\u00e9vision ou mise \u00e0 jour du r\u00e9gime<\/strong>, adapt\u00e9e aux dynamiques actuelles du march\u00e9 du travail, pourrait constituer une r\u00e9ponse plus appropri\u00e9e qu\u2019une abrogation pure et simple.
