Dans le pr\u00e9sent article, nous \u00e9voquerons ses axes les plus importants.<\/em>[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbN\u00e9gociation salariale\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb css=\u00a0\u00bb\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text css=\u00a0\u00bb\u00a0\u00bb]Le projet <strong>r\u00e9duit<\/strong> le poids de la participation de la Commission Nationale du Travail Agricole (CNTA) dans les relations individuelles, ce qui se manifeste \u00e0 travers les modifications suivantes :<\/p>\n<ul>\n<li><strong>N\u00e9gociation salariale.<\/strong> Le sch\u00e9ma <strong>tripartite<\/strong> (travailleurs, employeurs et \u00c9tat \u2013 CNTA) est abandonn\u00e9 et remplac\u00e9 par un mod\u00e8le <strong>bipartite<\/strong>, dans lequel les salaires devront \u00eatre convenus directement entre travailleurs et employeurs par le biais de la n\u00e9gociation collective, avec homologation ult\u00e9rieure par l\u2019Autorit\u00e9 d\u2019Application.<\/li>\n<li>La <strong>CNTA perd son r\u00f4le d\u00e9cisionnel<\/strong> en mati\u00e8re salariale et se limite \u00e0 la convocation de la n\u00e9gociation salariale du secteur, supprimant ainsi l\u2019intervention directe de l\u2019\u00c9tat dans la d\u00e9termination des r\u00e9mun\u00e9rations et renfor\u00e7ant l\u2019autonomie des parties dans la fixation des conditions salariales.<\/li>\n<li><strong>Les comp\u00e9tences de la CNTA sont express\u00e9ment limit\u00e9es<\/strong> \u00e0 celles qui sont \u00e9num\u00e9r\u00e9es de mani\u00e8re exhaustive, excluant toute possibilit\u00e9 d\u2019interpr\u00e9tation extensive de ses attributions.<\/li>\n<\/ul>\n<p data-start=\"746\" data-end=\"910\">Toutefois, le projet <strong>introduit<\/strong> une facult\u00e9 exceptionnelle permettant \u00e0 la CNTA de fixer des <strong>allocations non r\u00e9mun\u00e9ratoires<\/strong> en cas de suspension de la relation de travail r\u00e9sultant d\u2019urgences climatiques, \u00e9conomiques, de catastrophes naturelles ou de situations de force majeure, toujours avec l\u2019accord expr\u00e8s du secteur employeur et dans le cadre de programmes optionnels et non contraignants pour l\u2019employeur.<\/p>\n<p>[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbSuppression du statut du salari\u00e9 permanent \u00e0 activit\u00e9 discontinue\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb css=\u00a0\u00bb\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text css=\u00a0\u00bb\u00a0\u00bb]Le projet propose d\u2019introduire un changement structurel dans les modalit\u00e9s contractuelles du travail agricole en <strong>supprimant le statut du salari\u00e9 permanent \u00e0 activit\u00e9 discontinue<\/strong>. Les principales modalit\u00e9s resteraient alors le travail permanent \u00e0 prestation continue, le travail temporaire et le travail en \u00e9quipe ou en groupe familiale, faisant dispara\u00eetre la cat\u00e9gorie interm\u00e9diaire qui reconna\u00eet actuellement des droits \u00e0 indemnisation \u00e0 ceux qui sont embauch\u00e9s de mani\u00e8re r\u00e9p\u00e9t\u00e9e par un m\u00eame employeur pour des t\u00e2ches saisonni\u00e8res, cycliques ou li\u00e9es \u00e0 des processus temporaires propres \u00e0 l\u2019activit\u00e9 agricole.<\/p>\n<p data-start=\"1351\" data-end=\"1510\">La suppression du <span data-olk-copy-source=\"MessageBody\">statut du salari\u00e9 permanent \u00e0 activit\u00e9 discontinue<\/span> soul\u00e8ve des interrogations quant \u00e0 la situation des travailleurs qui, au moment de l\u2019entr\u00e9e en vigueur de la loi, se trouvent sous ce type de contrat. En particulier, la subsistance ou non de l\u2019obligation de convocation qui p\u00e8se aujourd\u2019hui sur l\u2019employeur \u00e0 chaque cycle productif ou chaque saison, ainsi que les droits \u00e0 indemnisation d\u00e9coulant de l\u2019anciennet\u00e9 d\u00e9j\u00e0 acquise par ces travailleurs, pourrait faire l\u2019objet de d\u00e9bats. L\u2019absence de dispositions transitoires sp\u00e9cifiques pourrait donner lieu \u00e0 des interpr\u00e9tations divergentes et \u00e0 des conflits potentiels quant \u00e0 l\u2019impact de l\u2019\u00e9limination de cette cat\u00e9gorie sur les droits acquis sous le r\u00e9gime ant\u00e9rieur.<\/p>\n<p>[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbModification de la p\u00e9riode d\u2019essai\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb css=\u00a0\u00bb\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text css=\u00a0\u00bb\u00a0\u00bb]En mati\u00e8re de p\u00e9riode d\u2019essai applicable aux travailleurs embauch\u00e9s pour une dur\u00e9e ind\u00e9termin\u00e9e, les dispositions de la loi sur le contrat de travail (LCT) s\u2019appliquent actuellement, laquelle pr\u00e9voit un d\u00e9lai de 6 mois. Le projet propose de modifier ce sch\u00e9ma en cessant de se r\u00e9f\u00e9rer \u00e0 la LCT et en \u00e9tablissant express\u00e9ment une <strong>p\u00e9riode d\u2019essai<\/strong> sp\u00e9cifique pour les travailleurs agricoles permanents \u00e0 prestation continue, port\u00e9e \u00e0 <strong>8 mois<\/strong>.<\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\"><\/a>[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbModification du r\u00e9gime de solidarit\u00e9\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb css=\u00a0\u00bb\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text css=\u00a0\u00bb\u00a0\u00bb]Dans le r\u00e9gime en vigueur, lorsque des travaux ou services propres \u00e0 l\u2019activit\u00e9 normale et sp\u00e9cifique de l\u2019\u00e9tablissement sont sous-trait\u00e9s et ex\u00e9cut\u00e9s dans son cadre, la loi consid\u00e8re que la relation de travail du personnel affect\u00e9 \u00e0 ces travaux ou services est \u00e9tablie avec le donneur d\u2019ordre (\u00e9galement appel\u00e9 \u00ab entreprise utilisatrice \u00bb), m\u00eame si les travailleurs ont \u00e9t\u00e9 enregistr\u00e9s par le sous-traitant. Le projet modifie ce crit\u00e8re : il \u00e9tablit que, dans tous les cas, <strong>les travailleurs seront consid\u00e9r\u00e9s comme des employ\u00e9s directs de celui qui enregistre la relation de travail<\/strong> (le sous-traitant), m\u00eame s\u2019ils ont \u00e9t\u00e9 embauch\u00e9s pour fournir des services au b\u00e9n\u00e9fice de tiers, supprimant ainsi la pr\u00e9somption l\u00e9gale actuellement applicable \u00e0 ces situations.<\/p>\n<p>Par ailleurs, le texte en vigueur pr\u00e9voit une responsabilit\u00e9 solidaire \u00e9tendue de l\u2019entreprise utilisatrice concernant les obligations de travail et de s\u00e9curit\u00e9 sociale du sous-traitant, y compris celles d\u00e9coulant de la rupture du contrat, et permet au travailleur d\u2019agir directement contre l\u2019entreprise utilisatrice, m\u00eame sans agir contre le sous-traitant. Le projet remplace ce r\u00e9gime par une solidarit\u00e9 plus limit\u00e9e, restreignant la responsabilit\u00e9 de l\u2019entreprise utilisatrice exclusivement aux obligations de travail et de s\u00e9curit\u00e9 sociale <strong>exigibles pendant la p\u00e9riode de prestation effective de services<\/strong> \u00e0 son profit.<\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\"><\/a>[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbCas particuliers de solidarit\u00e9 : preneurs \u00e0 bail et entreprises li\u00e9es\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb css=\u00a0\u00bb\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text css=\u00a0\u00bb\u00a0\u00bb]En ce qui concerne les propri\u00e9taires fonciers, le r\u00e9gime actuel exclut de l\u2019application de ces r\u00e8gles de solidarit\u00e9 uniquement ceux qui louent des terres ne constituant pas des exploitations productives. Le projet \u00e9largit consid\u00e9rablement cette exclusion en \u00e9tablissant que <strong>les personnes qui louent des terres, des machines ou des \u00e9quipements ne seront, en aucun cas, solidairement responsables<\/strong> des obligations des travailleurs enregistr\u00e9s par des tiers, \u00e9tant \u00e9trang\u00e8res \u00e0 la relation de travail.<\/p>\n<p data-start=\"4891\" data-end=\"5093\">Enfin, <strong>le projet abroge<\/strong> la norme qui \u00e9tablit actuellement <strong>la responsabilit\u00e9 solidaire entre entreprises subordonn\u00e9es ou li\u00e9es<\/strong> en ce qui concerne les obligations de travail et de s\u00e9curit\u00e9 sociale de chacune d\u2019elles. Cette modification supprime un autre cas important d\u2019extension de responsabilit\u00e9, renfor\u00e7ant un mod\u00e8le centr\u00e9 sur la responsabilit\u00e9 de l\u2019employeur enregistreur et limitant les situations dans lesquelles les travailleurs peuvent agir solidairement contre des tiers.<\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\"><\/a>[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbFonds d\u2019assistance au travail\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb css=\u00a0\u00bb\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text css=\u00a0\u00bb\u00a0\u00bb]Le projet cr\u00e9e un <strong>Fonds d\u2019assistance au travail<\/strong> (<em>Fundo de Asistencia laboral &#8211; FAL<\/em>) <strong>obligatoire<\/strong>, destin\u00e9 \u00e0 contribuer au paiement des indemnit\u00e9s l\u00e9gales d\u00e9coulant de la rupture du contrat de travail, y compris celles pr\u00e9vues par la loi sur le r\u00e9gime du travail agricole.<\/p>\n<p data-start=\"5450\" data-end=\"5708\">Les employeurs devront verser une contribution mensuelle de <strong>3 % des r\u00e9mun\u00e9rations<\/strong>, compens\u00e9e par une r\u00e9duction \u00e9quivalente des cotisations patronales au Syst\u00e8me int\u00e9gr\u00e9 de retraite argentin. Pour approfondir ce sujet, nous recommandons la lecture de notre <a href=\"https:\/\/wsclegal.com\/fr\/projet-de-loi-de-modernisation-du-droit-du-travail\/\">article<\/a> r\u00e9cemment publi\u00e9.<\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\"><\/a>[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbInt\u00e9r\u00eats\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb css=\u00a0\u00bb\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text css=\u00a0\u00bb\u00a0\u00bb]Dans la continuit\u00e9 de la r\u00e9forme de la LCT, le projet adopte le m\u00eame crit\u00e8re pour l\u2019actualisation des cr\u00e9ances judiciaires issues des relations de travail agricole. \u00c0 cet \u00e9gard, les int\u00e9r\u00eats ne pourront pas exc\u00e9der ceux qui r\u00e9sulteraient de l\u2019application de l\u2019indice des prix \u00e0 la consommation (IPC), major\u00e9s d\u2019un <strong>taux d\u2019int\u00e9r\u00eat annuel de<\/strong> <strong>3 %<\/strong>, l\u2019anatocisme \u00e9tant express\u00e9ment interdit.<\/p>\n<p data-start=\"6040\" data-end=\"6257\">Cet ajout vise \u00e0 fixer une limite et \u00e0 \u00e9tablir un crit\u00e8re plus uniforme pour les taux d\u2019actualisation appliqu\u00e9s dans les litiges judiciaires.
