Or, qu\u2019il agisse par d\u00e9crets ou cherche l\u2019appui du Congr\u00e8s, le pr\u00e9sident Milei devra encore se confronter \u00e0 la r\u00e9sistance des tribunaux comp\u00e9tents en mati\u00e8re de droit du travail (\u00ab Juzgados del Trabajo \u00bb) argentins. Ce ne serait pas une premi\u00e8re.<\/em>[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbContexte : la Ley de Bases et ses objectifs\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb css=\u00a0\u00bb\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text css=\u00a0\u00bb\u00a0\u00bb]En juillet 2024, le Congr\u00e8s argentin a adopt\u00e9 la Ley de Bases, le projet omnibus du pr\u00e9sident Milei visant la d\u00e9r\u00e9glementation et la modernisation de l\u2019\u00c9tat. Parmi les r\u00e9formes centrales figurait l\u2019\u00e9limination de plusieurs p\u00e9nalit\u00e9s \u00e0 la charge des employeurs. Ces p\u00e9nalit\u00e9s s\u2019appliquaient en cas de d\u00e9faut d\u2019enregistrement de la relation de travail, de non-paiement de l\u2019indemnit\u00e9 l\u00e9gale de licenciement ou de remise tardive des certificats de travail.<\/p>\n<p>Ces p\u00e9nalit\u00e9s, instaur\u00e9es il y a plusieurs d\u00e9cennies, cherchaient \u00e0 d\u00e9courager les pratiques d\u2019emploi illicites et \u00e0 garantir aux salari\u00e9s l\u2019acc\u00e8s \u00e0 l\u2019assurance maladie, aux accidents du travail et aux retraites. En effet, ces droits \u00e9taient r\u00e9serv\u00e9s aux travailleurs d\u00fbment d\u00e9clar\u00e9s. Toutefois, avec le temps, les tribunaux du travail ont appliqu\u00e9 ces p\u00e9nalit\u00e9s \u00e0 des situations qui exc\u00e9daient l\u2019intention initiale du l\u00e9gislateur. Ainsi, au lieu d\u2019assurer les droits fondamentaux du travail, les tribunaux sanctionnaient \u00e9galement des avantages accessoires non d\u00e9clar\u00e9s (p. ex. assurance sant\u00e9 priv\u00e9e, allocation de t\u00e9l\u00e9phone portable, voitures de fonction et indemnit\u00e9s de v\u00e9hicule). Les tribunaux appliquaient ces p\u00e9nalit\u00e9s m\u00eame lorsque les salaires et les primes r\u00e9currentes \u00e9taient correctement d\u00e9clar\u00e9s et que le salari\u00e9 b\u00e9n\u00e9ficiait de la couverture sociale et des droits \u00e0 la retraite.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbPourquoi ces p\u00e9nalit\u00e9s ont-elles encourag\u00e9 le contentieux ?\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb css=\u00a0\u00bb\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text css=\u00a0\u00bb\u00a0\u00bb]Puisque ces p\u00e9nalit\u00e9s \u00e9taient vers\u00e9es au salari\u00e9 \u2014 et non \u00e0 l\u2019\u00c9tat \u2014 elles ont davantage d\u00e9form\u00e9 l\u2019objectif pr\u00e9sum\u00e9 du l\u00e9gislateur en incitant les avocats des salari\u00e9s \u00e0 rechercher tout avantage non d\u00e9clar\u00e9. Le contentieux \u00e9tait particuli\u00e8rement courant pour les cadres dirigeants dont les demandes pouvaient repr\u00e9senter un gain substantiel. Ces facteurs augmentaient les co\u00fbts de licenciement, favorisaient les litiges et dissuadaient souvent l\u2019employeur d\u2019offrir des avantages en nature.<\/p>\n<p>En les supprimant, la Ley de Bases cherchait \u00e0 r\u00e9duire le co\u00fbt financier pour les employeurs et \u00e0 diminuer leur exposition, dans le but de limiter les contentieux avec des salari\u00e9s pourtant correctement enregistr\u00e9s.<\/p>\n<p>Cependant, des critiques ont \u00e9merg\u00e9 vis-\u00e0-vis de la r\u00e9forme. Celles-ci ont soutenu que la suppression des p\u00e9nalit\u00e9s \u2014 au lieu de les maintenir mais au b\u00e9n\u00e9fice de l\u2019\u00c9tat plut\u00f4t que du salari\u00e9 \u2014 an\u00e9antissait le principal m\u00e9canisme de responsabilisation des employeurs quant \u00e0 leurs obligations d\u2019enregistrement. Cette critique n\u2019est pas pass\u00e9e inaper\u00e7ue aupr\u00e8s des tribunaux. Les d\u00e9cisions r\u00e9centes montrent que, malgr\u00e9 l\u2019abrogation, les tribunaux du travail continuent d\u2019accorder des montants similaires aux demandeurs en les qualifiant de \u00ab dommages-int\u00e9r\u00eats \u00bb plut\u00f4t que de \u00ab p\u00e9nalit\u00e9s \u00bb.[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbLes p\u00e9nalit\u00e9s sous l\u2019ancien r\u00e9gime\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb css=\u00a0\u00bb\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text css=\u00a0\u00bb\u00a0\u00bb]La Ley de Bases a supprim\u00e9 trois p\u00e9nalit\u00e9s l\u00e9gales :<\/p>\n<ol>\n<li><u>P\u00e9nalit\u00e9 pour enregistrement irr\u00e9gulier<\/u>. applicable \u00e0 toute relation de travail non d\u00e9clar\u00e9e ou sous-d\u00e9clar\u00e9e. Le montant variait selon les faits. Si le salari\u00e9 agissait pendant la relation de travail, il avait droit au double de l\u2019indemnit\u00e9 l\u00e9gale de licenciement et \u00e0 25 % des r\u00e9mun\u00e9rations non d\u00e9clar\u00e9es. S\u2019il agissait apr\u00e8s la rupture, seule le doublement de l\u2019indemnit\u00e9 de licenciement pour anciennet\u00e9 s\u2019appliquait.<\/li>\n<li><u>P\u00e9nalit\u00e9 pour non-paiement int\u00e9gral de l\u2019indemnit\u00e9 l\u00e9gale<\/u>. Elle sanctionnait l\u2019employeur contraignant le salari\u00e9 \u00e0 r\u00e9clamer en justice une indemnit\u00e9 l\u00e9galement due. Elle \u00e9quivalait \u00e0 50 % de l\u2019indemnit\u00e9 l\u00e9gale.<\/li>\n<li><u>P\u00e9nalit\u00e9 pour remise tardive des certificats de travail<\/u>. Elle s\u2019appliquait lorsque l\u2019employeur \u2014 pour quelque raison que ce soit \u2014 ne remettait pas les certificats l\u00e9gaux dans les 30 jours suivant la fin de la relation.<\/li>\n<\/ol>\n<p>Cette p\u00e9nalit\u00e9 \u00e9tait particuli\u00e8rement s\u00e9v\u00e8re : trois fois la r\u00e9mun\u00e9ration mensuelle r\u00e9currente, souvent pour un simple oubli administratif.<\/p>\n<p>Pour une illustration chiffr\u00e9e, partons de l\u2019hypoth\u00e8se suivante :<\/p>\n<ul>\n<li>Salari\u00e9 percevant 10 000 USD\/mois, avec six ans d\u2019anciennet\u00e9 ;<\/li>\n<li>Licenciement intervenant en milieu de mois, \u00e0 la suite d\u2019une prise d\u2019acte du salari\u00e9 pendant la relation ;<\/li>\n<li>Omission de d\u00e9clarer une allocation t\u00e9l\u00e9phonique mensuelle de 100 USD.<\/li>\n<\/ul>\n<p>L\u2019indemnit\u00e9 l\u00e9gale serait d\u2019un peu plus de 87 000 USD. Les p\u00e9nalit\u00e9s ajouteraient : 86 800 USD (P\u00e9nalit\u00e9 1), 42 500 USD (P\u00e9nalit\u00e9 2), 30 000 USD (P\u00e9nalit\u00e9 3). Soit 159 300 USD en p\u00e9nalit\u00e9s, s\u2019ajoutant aux 87 000 USD d\u2019indemnit\u00e9 [1].<\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\"><\/a>[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbLa Ley de Bases et l\u2019abrogation des p\u00e9nalit\u00e9s\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb css=\u00a0\u00bb\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text css=\u00a0\u00bb\u00a0\u00bb]Comme indiqu\u00e9 plus haut, la Ley de Bases a supprim\u00e9 les trois p\u00e9nalit\u00e9s mentionn\u00e9es. \u00a0Toutefois, les tribunaux du travail tendent depuis \u00e0 accorder des dommages-int\u00e9r\u00eats en remplacement des sanctions l\u00e9gales. Cela cr\u00e9e une incertitude quant au respect du pouvoir judiciaire \u00e0 la volont\u00e9 du l\u00e9gislateur et, le cas \u00e9ch\u00e9ant, quant \u00e0 la port\u00e9e temporelle de l\u2019abrogation. Celle-ci s\u2019applique-t-elle \u00e0 toutes les affaires jug\u00e9es apr\u00e8s juillet 2024 ou seulement aux ruptures intervenues apr\u00e8s cette date ?<\/p>\n<p>Certains tribunaux provinciaux ont choisi de ne pas appliquer de p\u00e9nalit\u00e9s pour les affaires jug\u00e9es apr\u00e8s juillet 2024, m\u00eame si la rupture est ant\u00e9rieure.<\/p>\n<p>La position dominante \u2014 y compris \u00e0 Buenos Aires \u2014 est d\u2019appliquer la r\u00e9forme uniquement aux ruptures post\u00e9rieures [2].<\/p>\n<p>Plus pr\u00e9occupant encore : la volont\u00e9 des tribunaux d\u2019autoriser une demande en dommages-int\u00e9r\u00eats m\u00eame si l\u2019abrogation des p\u00e9nalit\u00e9s est jug\u00e9e constitutionnelle. Dans une affaire [3], le juge a consid\u00e9r\u00e9 que le d\u00e9faut d\u2019enregistrement et de paiement des indemnit\u00e9s l\u00e9gales causait un \u00ab pr\u00e9judice \u00e9vident \u00bb, ouvrant droit \u00e0 r\u00e9paration. Le salari\u00e9 avait pr\u00e8s de huit ans d\u2019anciennet\u00e9 et le montant accord\u00e9 \u00e9quivalait \u00e0 seize mois de salaire \u2014 soit un doublement de l\u2019indemnit\u00e9 d\u2019anciennet\u00e9.<\/p>\n<p>L\u2019indiff\u00e9rence apparente du tribunal au principe juridique selon lequel les dommages doivent \u00eatre prouv\u00e9s \u2014 et notamment ceux de nature d\u00e9lictuelle dans cette substitution de dommages-int\u00e9r\u00eats aux p\u00e9nalit\u00e9s est particuli\u00e8rement irritante. L\u2019attribution de <span data-olk-copy-source=\"MessageBody\">dommages-int\u00e9r\u00eats sans preuve<\/span>\u00a0d\u2019un pr\u00e9judice concret est juridiquement infond\u00e9e : c\u2019est une mani\u00e8re \u00e0 peine voil\u00e9e de r\u00e9introduire les anciennes p\u00e9nalit\u00e9s sous un autre nom.<\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\"><\/a>[\/vc_column_text][vc_custom_heading text=\u00a0\u00bbConclusion\u00a0\u00bb use_theme_fonts=\u00a0\u00bbyes\u00a0\u00bb css=\u00a0\u00bb\u00a0\u00bb skin=\u00a0\u00bbprimary\u00a0\u00bb show_border=\u00a0\u00bbyes\u00a0\u00bb border_skin=\u00a0\u00bbprimary\u00a0\u00bb border_size=\u00a0\u00bbxs\u00a0\u00bb][vc_column_text css=\u00a0\u00bb\u00a0\u00bb]Il semble d\u00e9sormais acquis que la Ley de Bases a supprim\u00e9 les p\u00e9nalit\u00e9s pour non-d\u00e9claration ou sous-d\u00e9claration de l\u2019emploi, ainsi que pour d\u2019autres manquements de l\u2019employeur. Toutefois, certains tribunaux cherchent \u00e0 maintenir ces dispositifs en les utilisant comme r\u00e9f\u00e9rence pour l\u2019\u00e9valuation des dommages. \u00c0 ce stade, l\u2019exposition de l\u2019employeur n\u2019a pas disparu : elle a simplement chang\u00e9 de forme.<\/p>\n<p>En Argentine, o\u00f9 le syst\u00e8me de droit civil repose sur la loi pour garantir la s\u00e9curit\u00e9 juridique, l\u2019attribution discr\u00e9tionnaire de dommages-int\u00e9r\u00eats conduira \u00e0 des r\u00e9sultats de plus en plus divergents. Dans l\u2019attente d\u2019un arr\u00eat unificateur de la Cour supr\u00eame, l\u2019octroi de dommages non pr\u00e9vus par la loi risque de neutraliser la r\u00e9forme et d\u2019annoncer de futurs conflits entre les tribunaux du travail et le programme de r\u00e9formes de Milei. (licenciement injustifi\u00e9) \u00bb.<\/p>\n<p>D\u2019autres tribunaux \u2014 notamment \u00e0 C\u00f3rdoba, Tucum\u00e1n et Mendoza \u2014 sont parvenus \u00e0 des conclusions similaires, tant pour les ruptures ant\u00e9rieures que post\u00e9rieures \u00e0 la r\u00e9forme. Ils ont confirm\u00e9 la constitutionnalit\u00e9 de la Ley de Bases et jug\u00e9 que la suppression des p\u00e9nalit\u00e9s ne violait pas la Constitution, tout en reconnaissant la responsabilit\u00e9 de l\u2019employeur lorsque son comportement cause un dommage.<\/p>\n<p>[3] \u00ab Vasold, Vanesa Soledad c.
