img_size=\u00bb\u00bb alignment=\u00bbcenter\u00bb css=\u00bb.vc_custom_1743090261591{margin-top: 0px !important;margin-bottom: 0px !important;padding-top: 0px !important;padding-bottom: 0px !important;}\u00bb label=\u00bb\u00bb][\/vc_column][\/vc_row][vc_row conditional_render=\u00bb%5B%7B%22value_role%22%3A%22administrator%22%7D%5D\u00bb el_class=\u00bbinternapost margenmob\u00bb css=\u00bb.vc_custom_1674404868551{padding-top: 50px !important;}\u00bb][vc_column width=\u00bb4\/5&#8243;][vc_column_text]<\/p>\n<h1><span style=\"color: #003e59;\">\u00bfC\u00f3mo Impacta el Decreto de Necesidad y Urgencia 70\/2023 en los Contratos de Locaci\u00f3n de Inmuebles para Vivienda y Uso Comercial?<\/span><\/h1>\n<p><strong><em>El Decreto de Necesidad y Urgencia 70\/2023 (el \u201cDNU\u201d) del 21 de diciembre de 2023 deroga la Ley 27.551 de Locaciones y modifica determinados art\u00edculos relacionados del C\u00f3digo Civil y Comercial de la Naci\u00f3n.\u00a0 Estos cambios afectan los contratos de locaci\u00f3n, tanto para vivienda como uso comercial. <\/em><\/strong>[\/vc_column_text][vc_custom_heading text=\u00bbLibertad de Contrataci\u00f3n\u00bb use_theme_fonts=\u00bbyes\u00bb skin=\u00bbprimary\u00bb show_border=\u00bbyes\u00bb border_skin=\u00bbprimary\u00bb border_size=\u00bbxs\u00bb][vc_column_text]En virtud de lo establecido por el DNU, las partes cuentan ahora con la libertad determinar las condiciones del contrato de locaci\u00f3n.[\/vc_column_text][vc_custom_heading text=\u00bbDuraci\u00f3n\u00bb use_theme_fonts=\u00bbyes\u00bb skin=\u00bbprimary\u00bb show_border=\u00bbyes\u00bb border_skin=\u00bbprimary\u00bb border_size=\u00bbxs\u00bb][vc_column_text]La duraci\u00f3n de los contratos de alquiler, con cualquier prop\u00f3sito, ser\u00e1 determinada por las partes, ofreciendo el DNU pautas espec\u00edficas solamente para casos en los que no se haya definido un plazo:<\/p>\n<ul>\n<li>En las locaciones temporales, se seguir\u00e1 el plazo establecido por los usos y costumbres locales del lugar donde se encuentra la propiedad objeto del contrato de locaci\u00f3n.<\/li>\n<li>En los contratos destinados a vivienda permanente, el plazo ser\u00e1 de dos (2) a\u00f1os, mientras que para otros destinos, se fija en tres (3) a\u00f1os.<\/li>\n<\/ul>\n<p>[\/vc_column_text][vc_custom_heading text=\u00bbMoneda del Alquiler\u00bb use_theme_fonts=\u00bbyes\u00bb skin=\u00bbprimary\u00bb show_border=\u00bbyes\u00bb border_skin=\u00bbprimary\u00bb border_size=\u00bbxs\u00bb][vc_column_text]El DNU establece que la obligaci\u00f3n consistir\u00e1 en entregar dinero cuando el deudor deba una cantidad espec\u00edfica de moneda, ya sea de curso legal o no en el pa\u00eds, al momento de la creaci\u00f3n de la obligaci\u00f3n. De tal forma, se pueden pactar ahora sin riesgo alquileres en d\u00f3lares u otra moneda extranjera. El deudor solo quedar\u00e1 liberado al pagar en dicha moneda y no puede pretender pagar en pesos al tipo de cambio oficial, salvo que as\u00ed se haya acordado espec\u00edficamente. M\u00e1s a\u00fan, el DNU establece que los jueces no pueden modificar la forma de pago o la moneda pactada.[\/vc_column_text][vc_custom_heading text=\u00bbAjuste\u00bb use_theme_fonts=\u00bbyes\u00bb skin=\u00bbprimary\u00bb show_border=\u00bbyes\u00bb border_skin=\u00bbprimary\u00bb border_size=\u00bbxs\u00bb][vc_column_text]Las partes tienen ahora la facultad de acordar el ajuste del valor de los alquileres. Se puede utilizar cualquier \u00edndice, ya sea p\u00fablico o privado, en la medida que sea expresado en la misma moneda en que se haya pactado el valor del alquiler.[\/vc_column_text][vc_custom_heading text=\u00bbFrecuencia de Pago de Alquiler\u00bb use_theme_fonts=\u00bbyes\u00bb skin=\u00bbprimary\u00bb show_border=\u00bbyes\u00bb border_skin=\u00bbprimary\u00bb border_size=\u00bbxs\u00bb][vc_column_text]Las partes tienen la facultad de acordar libremente la frecuencia de pago del alquiler aunque el DNU establece que la periodicidad no puede ser inferior a un (1) mes.[\/vc_column_text][vc_custom_heading text=\u00bbFianza o Dep\u00f3sito en Garant\u00eda\u00bb use_theme_fonts=\u00bbyes\u00bb skin=\u00bbprimary\u00bb show_border=\u00bbyes\u00bb border_skin=\u00bbprimary\u00bb border_size=\u00bbxs\u00bb][vc_column_text]El DNU otorga libertad a las partes para acordar la cantidad y moneda destinadas a fianza o dep\u00f3sito en garant\u00eda, as\u00ed como para determinar la modalidad de reembolso al finalizar el contrato de locaci\u00f3n.[\/vc_column_text][vc_custom_heading text=\u00bbRescisi\u00f3n y Resoluci\u00f3n Contractual\u00bb use_theme_fonts=\u00bbyes\u00bb skin=\u00bbprimary\u00bb show_border=\u00bbyes\u00bb border_skin=\u00bbprimary\u00bb border_size=\u00bbxs\u00bb][vc_column_text]El locador podr\u00e1 resolver el contrato por: (i) cambio de destino o uso irregular del inmueble; (ii) falta de conservaci\u00f3n de la cosa locada, o abandono; (iii) falta de pago del alquiler durante dos (2) periodos consecutivos; (iv) por cualquier causa fijada en el contrato.<\/p>\n<p>El locatario podr\u00e1 resolver el contrato en caso de (i) incumplimiento por parte del locador en la obligaci\u00f3n de conservar la propiedad apta para el uso y disfrute convenido -a menos que el da\u00f1o sea causado directa o indirectamente por el locatario-, y (ii) incumplimiento de la garant\u00eda de evicci\u00f3n o de vicios redhibitorios.<\/p>\n<p>El DNU establece la posibilidad de resoluci\u00f3n anticipada del contrato por el locatario en cualquier momento (antes solo era despu\u00e9s de los primeros seis meses).
