Decreto 70\/23<\/span><\/h1>\n<p>El 20 de diciembre de 2023, el Presidente Javier Milei emiti\u00f3 el Decreto 70\/23 de Necesidad y Urgencia (el \u201cDNU\u201d), que buscar desregular la econom\u00eda argentina a trav\u00e9s de numerosos cambios normativos. Uno de los puntos m\u00e1s importantes para inversores extranjeros es la derogaci\u00f3n de la Ley de Tierras.[\/vc_column_text][vc_custom_heading text=\u00bbAspectos Fundamentales de la Ley de Tierras\u00bb use_theme_fonts=\u00bbyes\u00bb skin=\u00bbprimary\u00bb show_border=\u00bbyes\u00bb border_skin=\u00bbprimary\u00bb border_size=\u00bbxs\u00bb][vc_column_text]La Ley 26.737 de Protecci\u00f3n al Dominio Nacional sobre la Propiedad, Posesi\u00f3n o Tenencia de las Tierras Rurales fue sancionada en diciembre de 2011, con el objetivo central de limitar el proceso de extranjerizaci\u00f3n de grandes superficies rurales.<\/p>\n<p>La norma establec\u00eda los siguiente:<\/p>\n<ul>\n<li>Limitaba en un 15% el l\u00edmite de toda titularidad de dominio o posesi\u00f3n por extranjeros (sean personas f\u00edsicas o jur\u00eddicas) de tierras rurales en todo el territorio nacional.<\/li>\n<li>Exig\u00eda que el 30% de ese porcentaje l\u00edmite permitido no comparta la misma nacionalidad extranjera.<\/li>\n<li>Establec\u00eda un m\u00e1ximo de 1.000 hect\u00e1reas en la zona n\u00facleo o superficie equivalente por titular extranjero.<\/li>\n<li>Prohib\u00eda la posesi\u00f3n por parte de extranjeros de las tierras que sean ribere\u00f1as de cuerpos de agua de envergadura y permanentes, y de inmuebles ubicados en zonas de seguridad frontera.<\/li>\n<\/ul>\n<p>A lo largo de los a\u00f1os, la normativa sufri\u00f3 varias modificaciones tendientes a flexibilizar la venta de las tierras rurales pero, aun as\u00ed, continuaba siendo un impedimento para los extranjeros interesados en invertir en Argentina, desalentando las inversiones en nuestro territorio nacional o generando la necesidad de armar complejas estructuras societarias y financieras para cumplir con la normativa.[\/vc_column_text][vc_custom_heading text=\u00bbDerogaci\u00f3n de la Ley de Tierras\u00bb use_theme_fonts=\u00bbyes\u00bb skin=\u00bbprimary\u00bb show_border=\u00bbyes\u00bb border_skin=\u00bbprimary\u00bb border_size=\u00bbxs\u00bb][vc_column_text]A partir de la entrada en vigencia del DNU la Ley de Tierras ya no es aplicable. El nuevo gobierno ha librado las negociaciones inmobiliarias a la voluntad de compradores y vendedores, a fin de promover la inversi\u00f3n en Argentina, principalmente en lo que es la bioeconom\u00eda.<\/p>\n<p>Este nuevo marco legal, caracterizado por la autonom\u00eda de la voluntad de los individuos, propone que las personas extranjeras, sean estas f\u00edsicas o jur\u00eddicas, no encuentren limitaci\u00f3n alguna vinculada a cuestiones de superficie, ubicaci\u00f3n, participaci\u00f3n accionaria, caracter\u00edsticas, o nacionalidad a la hora de pensar invertir en Argentina. Rige el principio de igualdad ante la ley para nacionales o extranjeros.[\/vc_column_text][vc_custom_heading text=\u00bbVigencia y Validez del Decreto 70\/23&#8243; use_theme_fonts=\u00bbyes\u00bb skin=\u00bbprimary\u00bb show_border=\u00bbyes\u00bb border_skin=\u00bbprimary\u00bb border_size=\u00bbxs\u00bb][vc_column_text]<\/p>\n<h2>Vigencia del Decreto 70\/23<\/h2>\n<p>El DNU entra en vigencia el <strong>29 de diciembre de 2023<\/strong>. El Jefe de Gabinete tiene 10 d\u00edas para mandarlo a revisi\u00f3n a la Comisi\u00f3n Bicameral del Congreso. La Comisi\u00f3n tiene 10 d\u00edas para recomendar su aprobaci\u00f3n o rechazo.<\/p>\n<h3>Revisi\u00f3n del Decreto 70\/23 en el Congreso<\/h3>\n<p>Despu\u00e9s de la recomendaci\u00f3n de la Comisi\u00f3n, o en ausencia de esta, ambas C\u00e1maras (C\u00e1mara de Senadores y C\u00e1mara de Diputados), deber\u00e1n votar para aceptar o rechazar el DNU.<\/p>\n<p>La votaci\u00f3n es sobre el conjunto del DNU, no se puede aceptar o rechazar parcialmente.\u00a0<strong>Si una de las dos C\u00e1maras lo aprueba, el DNU toma car\u00e1cter de ley<\/strong>.<\/p>\n<p>Por otro lado,<strong> si ambas c\u00e1maras lo rechazan, el DNU queda sin efecto<\/strong>, pero los actos realizados bajo su vigencia mantienen su validez.[\/vc_column_text][\/vc_column][vc_column width=\u00bb1\/5&#8243;][vc_widget_sidebar sidebar_id=\u00bbblog-sidebar\u00bb][\/vc_column][\/vc_row][vc_row conditional_render=\u00bb%5B%7B%22value_role%22%3A%22administrator%22%7D%5D\u00bb el_class=\u00bbsec-top margenmob\u00bb css=\u00bb.vc_custom_1674404924579{padding-top: 3% !important;padding-bottom: 15px !important;background-color: #e8eef5 !important;}\u00bb][vc_column][vc_column_text css=\u00bb.vc_custom_1703618764153{margin-bottom: 0px !important;padding-top: 5% !important;padding-bottom: 0px !important;}\u00bb]<\/p>\n<h2 style=\"text-align: left;
